Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN TO RESIDENTS OF THE 50 UNITED STATES SUBJECT TO THE LIMITATIONS DESCRIBED BELOW. VOID WHERE PROHIBITED BY LAW. The Bluefly “Fly & Mighty ‘Watch With Us’” Sweepstakes (the “Sweepstakes”) begins at 5:00p.m., E.S.T., on February 26, 2012 and ends at 1:00 a.m. EST on February 27, 2012. The Sweepstakes is sponsored by Bluefly, Inc. (“Bluefly”). Participation constitutes entrant’s full and unconditional agreement to, and acceptance of, these official rules and the decisions of Bluefly, which are final.

How to Enter and Eligibility: Subject to the limitations described below, natural persons at least 18 years of age at the time of entry who are legal residents of the 50 United States or the District of Columbia may enter the Sweepstakes online at flyandmighty.com or Facebook.com/Bluefly by submitting an email address as directed (a “Submission”). Void where prohibited by law. Entries must be received between 5:00 p.m., EST, on February 26, 2012 and 1:00 a.m., EST, on February 27, 2012. Bluefly is not responsible for, and shall not be liable for, late, lost, damaged, misdirected, illegible or incomplete entries, failure or malfunction in electronics, hardware, software, communications or security or unsuccessful efforts to notify winner. If dispute over online entry arises, entry will be deemed submitted by authorized e-mail account holder. All entries become exclusive property of Bluefly.com and will not be acknowledged or returned. Employees, officers and directors of Bluefly, and their respective affiliates, advertising and promotion agencies and those with whom they are domiciled are not eligible.

Prize and Winner: One Winner will receive a Bluefly electronic gift certificate with a total retail value $100.00.The electronic gift certificate will be awarded in the form of a credit to User’s Bluefly Account. In order to redeem the $100 gift certificate, the User must have or create a Bluefly account and have a valid credit card on file. The prize winner will be chosen at the discretion of Bluefly. Prizes are not transferable, exchangeable or redeemable for cash. Winner will be notified by e-mail and/or telephone within 5 business days of the end of the Sweepstakes. Bluefly reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes. By participating in the Sweepstakes, each participant agrees to release and hold Bluefly and its employees, officers, directors, shareholders, agents, representatives, affiliates, advertising and promotion agencies and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possess, or use of any prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. All federal, state/provincial and local taxes not listed in prize are sole responsibility of the winners. Bluefly may administer the Sweepstakes in its sole discretion and may disallow any votes that it determines, in its sole discretion, are fraudulent or otherwise violate these rules in any way.

Registration Information: When you register for the Sweepstakes, you create a Bluefly account that allows you to use the same email address when you return to the Bluefly Web Site independent from the Sweepstakes. This information is subject to Bluefly privacy policy and will not be used for any purpose other than those indicated in the Bluefly privacy policy. Participants who create a Bluefly account by registering for the Sweepstakes will be automatically opted-in to receive future emails from Bluefly, but will have the option to opt-out after receiving emails.

Submissions: You represent and warrant that you have received permission from each person included in a Submission (each, a “Subject”) to submit the Submission, and that you and each Subject understand and agree that BLUEFLY may display the Submission publicly, both on its website and in other media.. You further represent that your Submissions do not infringe any third party’s intellectual property rights, do not invade any third party’s privacy, are not illegal, obscene, threatening, abusive, libelous, slanderous, defamatory, fraudulent , misleading, prejudicial or otherwise injurious to third parties. You may not impersonate anyone in any posting and may not mislead anyone as to the source of any Submission. You are solely responsible for any Submission. Bluefly reserves the right to screen, remove or edit any Submission, but is under no obligation to do so. Under no circumstances will Bluefly be liable for any Submission or any damage caused by the publication of such Submission. When you make a Submission, you are automatically granting Bluefly and its affiliates a royalty-free, worldwide, non-exclusive, perpetual, fully sublicensable and irrevocable right to use, distribute, reproduce, modify, adapt, publicly perform and display, translate and create derivative works from such Submission in any media, as well as the right to use your name and the name and likeness of any Subject in connection with such Submission, if Bluefly so chooses.. You also agree that Bluefly may keep records indicating that you are the source of a Submission, and any information related to your Submission, and may disclose such information as it may determine, in its sole discretion, including, without limitation, in order to comply with law or legal process, to enforce the terms of these conditions of use, to respond to any complaint that such Submission violates the rights of any third party, to respond to customer service requests or to assist in the protection of any person.

The posting of any Submission on Bluefly’s web site should not be construed as an indication that such Submission is a winning entry.

Winner Determination: Winners will be determined via the processes set forth below for this Sweepstakes. All selected potential winners must comply with all terms and conditions of these Official Rules, and all winnings are contingent upon fulfilling all requirements. Bluefly’s decisions as to the administration and operation of the Sweepstakes are final and binding in all matters related to the Sweepstakes. The winner will be selected by random drawing on or around January 20, 2012. The potential winner (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to Bluefly, within seven (7) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability and Publicity Release in order to claim his/her prize and fulfill any such other requirements as determined by Administrator. If any potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release (when applicable) within the required time period, potential winner forfeits prize. If any potential winner cannot be contacted or if prize is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a grand prize is disqualified for any reason, Bluefly will award the applicable prize to an alternate winner of their choosing. There will be three (3) alternate winners named after which the applicable Grand Prize will remain un-awarded. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Sweepstakes. Bluefly will notify the potential winners by mail, email or phone at that time.

Non-endorsement: The use of any trademarks, service marks, logos or other marks in connection with the Sweepstakes or any prize, other than those of Bluefly, is not meant to imply the endorsement of the respective owner(s) of such marks, or any affiliation of the respective owner(s) of such marks with the Site or the Sweepstakes.
